On December 24, 2024, Spain's Official State Gazette published in the Official Gazette of Spain the Royal Decree 1312/2024, which establishes the One-Stop Digital Leasing Window.. This regulation has a direct impact on all individuals or legal entities that advertise tourist or seasonal rentals through online platforms such as Airbnb or Booking.

 

Who is affected by this law?

The new law applies to:

  • Tourist rentals (HUT, up to 31 days): only owners with a valid tourist license may apply for the new registration number.
  • Seasonal rentals (1 month or more): These homes must also be officially registered in order to continue operating legally.

All properties under any of these modalities must register in order to continue advertising on online platforms.

What obligations does this law impose?

  • As of July 1, 2025, it will be mandatory to have a registration number for both tourist and seasonal rentals.
  • If the same dwelling is used for both purposes, the following will be needed two different registration numbers.
  • Platforms must verify the registration number before publishing any advertisement and are obliged to remove, within a maximum of 48 hours, the advertisements associated with a revoked number.
  • The service provider (natural person or company) must present a annual declaration of activity.

Who should apply for the registration number?

Although the Royal Decree establishes that the service provider must apply for it, initial interactions with the property registrars suggest that the registrant must sign the application. However, a third party may file it on his behalf, provided that he has a power of attorney.

If you are the owner and you directly manage the rental, you can apply for it in your name without any problem. Sublessors and managers can also do so if they have the corresponding authorization.

  • Online: through the official portal of the Ministry of Housing and Urban Agenda.
  • In person: in the Land Registry where the property is registered.
