To legally operate a tourist dwelling in Barcelona, it's not enough to prepare the apartment and list it on a platform. The property must have tourist accommodation authorization, comply with urban planning regulations, and meet a series of technical, registry, and operational conditions.. Furthermore, Barcelona maintains a particularly restrictive framework and plans to extinguish current licenses in 2028, so it is advisable to check the specific situation of each property before making decisions or investments.

What is considered a tourist dwelling

A tourist dwelling, commonly known by the acronym HUT, is one that its owner leases in its entirety to third parties, in exchange for financial compensation, during Stays of 31 days or less. The rental can be marketed directly or through platforms, agencies, and management companies.

The dwelling must be transferred as a complete unit. Therefore, Renting out rooms for tourism does not convert the property into a tourist rental unit. and is subject to a different regime. It should also not be confused with a tourist apartment: the latter is part of an establishment specifically dedicated to accommodation and falls under a different administrative regulation.

In our guide to the difference between vacation home and tourist apartment We explain in more detail why these two terms are not interchangeable, even though they are used as synonyms in everyday language.

Can you currently get a new tourist license in Barcelona?

This is the first point any owner should check. Meeting the physical requirements for a residence does not guarantee that it can be used for tourism purposes. The activity must also be compatible with urban planning and have the corresponding municipal permit.

In Barcelona, the implementation of tourist accommodations is conditioned by the Special Urban Plan for Tourist Accommodations, known as PEUAT. In practice, The city does not function as an open market for new HUT licenses. The possibility of starting a new business is limited by zoning, property location, and municipal decisions on density and land-use compatibility.

In addition, the Barcelona City Council has announced that the licensing of existing tourist accommodations they will not be renewed when their term expires in 2028. This substantially changes the economic analysis of a licensed property, because its current situation should not be interpreted as indefinite authorization.

Before buying, renovating, or marketing a property as a tourist rental, you must separately check the municipal license, its validity, the tourist registration, the community's limitations, and the property's urban planning future.

For this reason, it's advisable to be wary of expressions like “apartment suitable for tourist license” when they are not accompanied by verifiable documentation. In Barcelona, there is no automatic right to obtain a permit. simply because the property meets certain requirements for size, amenities, or habitability.

Administrative requirements for a tourist accommodation

A legal tourist accommodation requires several layers of compliance. The municipal license and the regional registration do not replace each other. Each element serves a different purpose and is necessary to operate and advertise the accommodation.

Hold a valid municipal permit

The owner must have the title that authorizes the exercise of the activity at that specific address. The municipal administration verifies that the use is compatible with the urban planning and that there is no urbanistic limitation that prevents the activity.

The permit is linked to the property and the declared conditions. An apparently existing license must be checked against municipal records, especially in cases of sales, title changes, home modifications, or discrepancies between the physical reality and the documentation.

Be registered in the Tourism Registry of Catalonia

When the City Council validates the authorization, it communicates the data to the Generalitat so that the accommodation is registered in the Registry of Tourism of Catalonia. The corresponding tourist identification number derives from that registration.

The NIRTC officially identifies accommodation and, currently, it is the reference number that must accompany any accommodation listing, along with the municipal license. In our guide on What is the NIRTC We discuss its function and common errors in interpreting it.

What happened to the Single Registry of Leases (and what is still missing)

Throughout 2025 and much of 2026, Royal Decree 1312/2024 made it mandatory to obtain a Single Rental Registry number in order to advertise short-term accommodations on digital platforms such as Airbnb or Booking. That number, distinct from the municipal license and the NIRTC, was presented as an additional nationwide requirement.

That obligation is no longer in effect. The Supreme Court, in a ruling dated May 19, 2026, annulled the Single Rental Registry procedure established by Royal Decree 1312/2024, considering that the State lacked the jurisdiction to impose a national registry that overlapped with pre-existing regional registries in the areas of housing and tourism. The ruling does uphold the Digital Single Window and the obligation for platforms to transmit certain data for statistical purposes, but eliminates the single registry as a requirement to operate.

In practice, this means that It is no longer necessary to obtain or display a Single Registry of Leases number to advertise a tourist accommodation. What remains essential, unchanged, is what the Catalan and municipal framework already required:

  • the valid municipal license for that specific dwelling;
  • registration in the Tourism Registry of Catalonia and the corresponding NIRTC;
  • the rest of the technical, registry, and community conditions described in this guide.

It is worth noting that this is an area where the division of responsibilities between the State and the autonomous communities may continue to shift: a different coordination mechanism cannot be ruled out in the future. Therefore, although the state registry is not currently required, we recommend verifying the current status before publishing an advertisement or closing a sale, especially if dealing with documentation or advertising from before May 2026 that still refers to that number.

Check the status of the homeowners' association

Bylaws and community agreements can limit or prohibit tourist use. Furthermore, as of April 3, 2025, owners who wish to engage in this activity in a building subject to the horizontal property regime must first obtain the express approval of the community, with the legally stipulated majority.

In general, it is required the favorable vote of three-fifths of the total owners and of the participation quotas. Activities that were already legally carried out before this requirement came into effect may find themselves in a different situation, although they must comply with applicable prohibitions and agreements.

The review should not be limited to the minutes of the last meeting. It is advisable to analyze the registered bylaws, subsequent amendments, community agreements, and the date the activity began. A statutory prohibition can prevent both the exploitation and obtaining the registration number required to advertise it.

Conditions that the property must meet

The dwelling must be legally habitable and ready for immediate occupancy. The regulations require real conditions of safety, hygiene, and equipment, not just a decent appearance in the advertisement photos.

Certificate of Occupancy in effect

The property must have a valid certificate of occupancy. This document certifies that it meets the minimum requirements for use as a residence and specifies its maximum occupancy.

You cannot accommodate more people than the number authorized on the ID card. A residence with more beds than the number of authorized guest spaces does not legally increase its capacity and may result in penalties, problems with guests, and conflicts with the community.

Sufficient furniture and equipment

The housing must be delivered furnished and equipped with the necessary items for immediate use. The evaluation is not based solely on the presence of beds and a kitchen: The equipment must be consistent with the advertised capacity and be in proper working condition.

Items to be checked include furniture, kitchen utensils, bedding, water and electrical systems, ventilation, lighting, and the appliances included in the offer. There must also be a clear correspondence between what is advertised and what the guest receives.

Cleaning, Maintenance, and Condition

The residence must be kept clean and hygienic throughout the entire activity. Compliance doesn't end once you obtain the license: Each stay requires preparing the accommodations, identifying malfunctions, and responding quickly to any issues.

At BCN Flat Management, we address this issue through a integral management of tourist apartments in Barcelona, coordinating everything from marketing to cleaning, maintenance, and guest services. This operational continuity reduces the risk that a property that has been formally licensed will subsequently operate below the required standards.

Information and Guest Services

The property owner must provide guests with sufficient information about the use of the property and the rules for coexistence. There must also be a contact method available to address questions and issues related to the stay.

The response to problems must be effective, not merely formal. A water leak, a blocked access point, or a complaint from a neighbor requires clear protocols and the ability to take action. Internal rules help prevent conflicts, but they must be clearly communicated and consistently enforced.

To organize them, please refer to our guide on Essential Guidelines for a Vacation Rental, where we address issues such as noise, visitors, the use of common areas, and waste management.

Obligations During the Occupancy of the Residence

Once the business has started operations, the owner or manager must maintain a system of ongoing compliance. The legality of the lodging depends both on the documentation and on the way it is operated.

Correctly display the tourism identification number

Advertisements and commercial communications must include the NIRTC corresponding to the accommodation, linked to the municipal license and the registration in the Tourism Register of Catalonia. Following the annulment of the Single Tenancy Register by the Supreme Court, it is not necessary to include the state number that some platforms came to require during 2025 and early 2026.

Posting a nonexistent, incorrect, or incomplete code does not make the ad compliant.. Platforms can block it, and government agencies can automatically cross-check the published information against official records.

Record and report passenger information

Accommodation providers must collect and report the information of their guests through the system established by the Ministry of the Interior. This requirement involves correctly identifying travelers, retaining the information, and submitting it within the applicable timeframes.

Management must be carried out in a manner that simultaneously complies with security and data protection obligations. It's not enough to simply ask for a casual photo of the ID: It is advisable to implement a controlled procedure to verify, record, and safeguard the information.

Collecting and Reporting the Tourist Tax

Stays at tourist accommodations are subject to the tax on stays at tourist establishments in Catalonia and, in Barcelona, to the corresponding municipal surcharge. The amounts may vary depending on the category, type of accommodation, and dates of the stay.

The tourist tax must be properly incorporated into the booking and payment process. An error in its configuration can lead to discrepancies between what is charged to the guest and what should be declared to the Administration.

Handling complaints and fostering harmony

The residence must have the required information and complaint procedures in place. In addition, the owner is responsible for ensuring that the service is provided properly and must take action against behavior that disrupts community life or violates community rules.

Professional management requires monitoring arrivals, departures, occupancy, noise, cleanliness, and the use of common areas. Neighborly relations are part of operational compliance And it shouldn't only be addressed when a complaint is filed.

documentation tourist license barcelona

Documentation to review before operating or purchasing a HUT

The purchase and sale of a home advertised as a tourist property requires a more extensive review than that of a conventional residential apartment. The value of the asset may depend on a limited, disputed, or about to expire license., so the license should never be considered valid solely because the property appears on a platform.

Before signing or incurring expenses, it is advisable to verify at least the following documentation:

  • Municipal enabling title and current administrative status;
  • valid habitation certificate and maximum capacity;
  • registration and number of the Tourism Register of Catalonia (NIRTC);
  • Property registry note and correspondence with the advertised property;
  • bylaws, regulations, and agreements of the homeowners' association;
  • Date of commencement of activity;
  • sanction files, demands, or open proceedings;
  • tax or community debts related to the exploitation;
  • match between actual distribution, plans, cadastral information, and documentation.

This check allows us to separate three scenarios that are often confused: a fully authorized dwelling, a property that had past activity, and a property marketed as “tourist” without sufficient title. Each situation has different legal and economic consequences.

We must also consider the horizon of 2028. In our Tourist License Guide in Barcelona We analyze recent changes and checks that owners should perform in light of the new regulatory scenario.

Common mistakes when checking if an apartment can be rented out to tourists

One of the most common mistakes is thinking that registering on a platform demonstrates the legality of the accommodation. An active listing does not equate to a valid license, just as a number included in the description does not guarantee that it actually corresponds to that unit.

It is also common to confuse a change of ownership with the granting of a new license, to assume that the authorization is automatically transferred with the sale, or to believe that any rental under one year can be treated as tourist. The purpose and applicable regulation matter: A seasonal contract should not be used to disguise tourist stays..

Other common errors include:

  • buying the property without reviewing the community statutes;
  • to announce more vacancies than authorized by the charter;
  • continue demanding or searching for the Single Lease Registry number, annulled since May 2026;
  • start marketing while the municipal procedure is still pending;
  • omit tourist tax or guest registration;
  • no immediate attention to incidents;
  • calculate profitability as if the license were indefinite.

The best way to avoid these problems is to order the checks: first legal and urban planning feasibility, then registry and community status, and finally operational capacity. Preparing the floor before verifying its readiness can turn an investment into an expense that's difficult to recover..

Frequently Asked Questions about HUT Requirements in Barcelona

Can I apply for a tourist license for any property?

No. The housing must meet habitability conditions, but it also needs urban planning compatibility and municipal authorization. In Barcelona, the granting of new licenses is heavily restricted., so meeting the physical requirements does not imply that the City Council authorizes the activity.

Can I rent out just one room to tourists?

Not under the figure of tourist accommodation. The HUT is rented out in its entirety to a single group during the stay. Tourist room rentals are not covered by a HUT license. and may be subject to other limitations.

Is the license automatically transferred when selling the apartment?

It should not be presumed. The purchase and sale and change of ownership require review of the title, current regulations, and corresponding administrative procedures. The transfer of the property does not substitute the required communication or validation..

Is the Single Rental Registry number still mandatory?

No. In May 2026, the Supreme Court annulled the Single Rental Registry procedure created by Royal Decree 1312/2024, considering that it infringed upon regional jurisdictions. Since then, it is no longer required to obtain or display that number to advertise a tourist home; what remains essential is the municipal license and registration in the Tourism Registry of Catalonia (NIRTC).

Can the community ban the activity?

It can be limited or prohibited through legally established mechanisms and the horizontal property regime. For new activities started from April 3, 2025, prior express approval from the community is also required, as stipulated by law.

What will happen with tourist apartments in Barcelona in 2028?

The City Council has stated that it will not renew current permits when they expire in 2028. Owners must plan with this horizon and avoid indefinite profitability projections. Regulatory or judicial evolution must be followed until that date.

How to correctly evaluate a tourist rental in Barcelona

The right question is not just whether the apartment has beds, a lease, or a number published online. We need to determine if the activity is enabled today, if the documentation matches the property, and for how long it can be maintained.

An orderly review must analyze the municipal license, the regional tourism registry, the homeowners association, the authorized capacity, and operational obligations; the former Single Registry of Leases is no longer part of that list following its judicial annulment. In Barcelona, a decisive factor is added: the scenario projected for 2028. Therefore, before marketing, purchasing, or taking over the management of a tourist apartment (HUT), we recommend working with verified documentation and a strategy that considers both the current operation and the future alternatives of the property.
